These Terms of Service govern your access to and use of the 1099 Assistant website, application, and services operated by 1099 Assistant. By creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Description of Service
1099 Assistant is a financial tracking tool designed to help US-based independent contractors and self-employed individuals track income, expenses, mileage, and estimate tax obligations.
NOT TAX, LEGAL, OR FINANCIAL ADVICE. 1099 Assistant is not a certified public accountant (CPA), tax advisor, attorney, or financial planner. The Service is intended solely to assist you in organizing your financial data. All tax calculations, estimates, and suggestions are for informational purposes only and should not be relied upon as professional tax advice. You are solely responsible for the accuracy of your tax filings and should consult with a qualified tax professional.
3. User Responsibilities
- You are solely responsible for the accuracy, completeness, and legality of all data you enter.
- You are responsible for maintaining the security of your account credentials.
- You will verify all tax calculations with a qualified tax professional before filing.
- You are responsible for maintaining your own backup copies of important data.
- You will comply with all applicable federal, state, and local laws.
4. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free.
- Tax calculations, estimates, or deduction suggestions will be correct or comply with current IRS regulations.
- Any errors or defects in the Service will be corrected.
- The Service will be free from viruses or harmful components.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1099 ASSISTANT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to: loss of profits, revenue, or data; inaccurate tax calculations resulting in penalties or additional taxes; errors in mileage tracking or expense categorization; unauthorized access to or alteration of your data; any data loss, corruption, or breach of security.
Our total liability shall not exceed the total amount you paid us in subscription fees during the twelve (12) months preceding the claim.
6. Data Security and Privacy
We implement commercially reasonable security measures including encryption, HTTPS, and access controls. However:
- No method of electronic storage or transmission is 100% secure.
- We cannot guarantee absolute security against unauthorized access, hacking, or data breaches.
- You provide your data at your own risk.
- In the event of a data breach, we will notify affected users as required by law.
7. Tax Estimate Accuracy
Tax estimates are approximations only. Actual obligations may differ significantly. We strongly recommend consulting a licensed CPA or tax professional. We accept no liability for discrepancies between our estimates and your actual tax obligations.
8. Mileage Tracking
GPS measurements may not be 100% accurate. You are responsible for verifying mileage logs before using them for tax deductions. The IRS mileage rate used may not always reflect the most current rate.
9. Subscription and Billing
Pro is a paid yearly subscription. It renews automatically each year until you cancel, at the price shown when you subscribed.
You can cancel at any time yourself from Subscription, then Manage billing. We reserve the right to change pricing with 30 days notice before your next renewal.

10. Account Termination
We may suspend or terminate your account for conduct that violates these Terms. Upon termination, your right to use the Service ceases. You can close your account yourself at any time from Security settings, and download a copy of your data first.
11. Indemnification
You agree to indemnify and hold harmless 1099 Assistant from any claims, damages, losses, and expenses arising from your use of the Service or violation of these Terms.
12. Governing Law
These Terms shall be governed by the laws of the State of Texas. Disputes shall be resolved in the courts of Harris County, Texas.
13. Changes to Terms
We may modify these Terms. We update the date at the top, and tell you by email before a material change takes effect. Continued use after changes constitutes acceptance.
